my mother got married to a man a little over a year ago and lives in florida with him. They recently had a baby. now she is not happy he treats her really badly and doesnt let her even visit her family. and she wants out. but he constantly threatens her with their baby. she would like to move back to rhode island where her whole family is. she doesnt have anyone in florida. is there anyway she can take the baby out of the state to move back to rhode island?? i am also having a baby in less than 2 months. she is supposed to come to ri for my baby shower and he is now threatening her about that because she booked the tickets. and she is supposed to come down again when the baby is born and im sure he will give her problems about that too. Any advice on what she can do??

If she gets herself and her baby on the plane to RI then she is home free. She needs to report his violent behavior (threats, etc.) to the police, if possible while she is still in Florida. She can go to a women's shelter in RI and stay there.

She will need to file for divorce immediately and include his violent behavior as part of the reason. That will make sure that he gets no chance of custody of their child. The shelter will help with these proceedings.

Do not have her stay at your house, because he might show up. He may show up even if she is not there. Do not tell him where she is. Do not take any of this lightly. These men are dangerous and may do physical harm.

Take care,
Troy

Yes go get your mother and get her now cause no one should stay in an abusive relationship and if he gives her a hard time up there have him put in jail . It is called domestic violence . No one should have to put up with that crap not in this day and age . No the baby is hers and if he tries to get her for kidnapping tell them that she left because she felt like her life was in danger and have her file a temporary restraining order on him to keep him away . When you go to get her make sure she has everything ready when you get there . Have the baby's things packed and hers as well . You must do this while he is at work . Also get out of there as fast as you can cause I would not want to hear of anyone getting hurt. good luck and I hope all turns out well for all of you.

www.fcadv.org (florida domestic abuse)
www.ricadv.org (rhode island domesic abuse)

contact the people in the above website and they should be able to answer questions and to help you help your mom. first of all...if she is being abused then she needs to file a police report. cause if she takes the baby out of state...he can have her arrested for kidnapping (another control abuse tactic). this will have to be planned out carefully but it can happen. she already booked the tickets...then she will need to make a decision to leave and never come back. this will have to be planned carefully so that she doesn't run the risk of being arrested for anything such as kidnapping. but contact the florida domesitc abuse first. because laws are different in every state. that's why i gave you rhode island also.

Talk to other members of the family. Take a few days off from work and drive down to Florida and drive your mother home. If there's that much space between them and he's bad to her, of course she can leave. No one has to stay in an abusive situation. And if he moves up here and starts giving her a hard time, she can take legal action against him.

Make a way for her to leave. Does he work? If so, she can hop a plane while he is gone. Or stay at a shelter until family can pick her up. Be smarter than the guy. Good Luck.

She does not have to have his permission to take that baby anywhere. If she wants to take it out of state, there is nothing he can do. You need to talk to her and try to convince her to get out now. The older the childs gets, the harder it will be for her to leave because she will feel like she needs to stay for the child's sake.
Have a heart to heart talk with her. I wish my children had when they were younger. It would have helped me leave earlier.

Good luck

Tell her to get out while she can. I know it is going to be hard on her but she needs to look out for the baby and her own safety. Also, you need to be careful what you do because you are expecting (CONGRATULATIONS) and you don't need to be all worked up and stressed out. Tell her to pack up and get out. If he keeps threating her she can take legal action. GOOD LUCK!

you can't take the baby out of state without her husbands permission. She will have to get a legal separation and have her move agreed on by both parties.
