I have been a trainee at a recruitment agency for three months and instead of hiring me permanently, as it was the original plan, they have to let me go due to strong financial difficulties. They have always refused to get a heater to our office during winter and I heard that I constantly 'complained' about getting a heater. So, I didn't get a heater for two cold winter months. Also, people smoke just behind a window next to my desk and even though I have asked them to go further away, one particular supervisor ignores my wishes and continues to smoke near my window. As a third point, I am 4 1/2 months pregnant, which I know they have acknowledged but haven't mentioned to me personally. I haven't told them myself as it is not yet a legal obligation.I feel more ignorance towards my wishes and rights. Do you think I have been discriminated because of my pregnancy and wishes to have a warm non-smoking work environment? Would anyone have any legal knowledge? Does a trainee have rights?

It is hard to give an opinion on the basis of what you have said about your job and the agreement under which you started it. You would be best advised having a word with the EOC -- the Equal Opportunities Commission. When you say they have to let you go do you mean they have already let you go or that they have told you they will be doing?

The legal limit for temperature in the Health and Safety legislation is 16 degrees C. If the temperature was above that then there is little you can do about that. With regards to smoking, this is a tricky area but there is probably not very much you can do about that either.

With regard to your pregnancy, are you sure that the reason you are not being kept on is nothing to do with your pregnancy? If so, then this is Sex Discrimination and you could take action against them. If you have been there 3 months and are 4 and a half months pregnant already then you are borderline as to entitlement to any maternity pay since you have to have been there for 26 weeks by the 15th week before the date you are due to qualify.

Obviously I dont know y ou personally but it may be the way your handling it all.

I hate the cold and i jcan understand why you wouldnt be happy about the smoking but maybe the people you work for are just bitches and they dont give a hoot about you.

thats what it sounds like.

i would forget about the heater situation and maybe raise the smopking issue to the top dog manager while telling them your pregnant. they might be annoyed that in a couple of months your going to be going off on maternity or leaving anyway.

how cold was it because there is laws about it being too cold???

I know t his wasnt all much use to you but im just making soem suggestions on their behavior but it just sounds like theyre cows

I don't want to be the one to break this to you but if you have only been there 3 months, I wouldn't expect anyone to waste their time catering to you.
You have the right to find a work environment more to your tastes.

Don't take it so personally - if they are in financial difficulties as you say, then probably best that you don't work for them and get a job elsewhere?
