Depends on what state you're in. As to how to handle a relationship breakup, my suggestion is to seriously consider couples counseling. I don't suggest this to keep you together, but if you're committed to the breakup, a lot of strong emotional issues will come up between you and your spouse, and a lot of emotional issues come up with the kids. So, couples counseling will help smooth over some of the rough spots and can be comforting for some of the lonely spells you'll both experience. Also, it will be very helpful to the kids of the two of you get some professional counseling on dealing with children and divorce. Good luck.

Get some personal counselling and speak with a lawyer. Don;t make the move until you know all your options and have worked through your feelings. At all times keep the kids foremost in your mind, because the breakup will be bad enough. If it gets dirty or nasty between you and hubby, it will just be harder on them. Good Luck.
