After telling my new cosmotologist my head was sensative I hired a her. She left me with the strongest odor dye I have EVER smelt for over an hour! She left me unattended for the entire hour while she went to lunch! When she returned I told her to please take the dye out it was sizzling my scalp. When she took the dye out...I had blood everywhere. I later found out that my scalp was chemically burnt! I had open blisters and a raw scalp...all over my head! I have so many headaches and it is 5 months later! My questions are:
1. Can you get chemical poison from this?
2. Does anyone know about cosmotology injury laws?
3. Where should I sue? Civil or Small claims?
4. What would you do?
5. Got any advice?

First, you need to go to a doctor, al specialist, a dermatologist, to determine the nature of the injury, and be treated to minimize the pain and prevent infection and help the healing.

Second, you need to contact a lawyer who specializes in personal injury cases, to find out what your rights are in your state. Each state may have different laws and rules about an injury such as this.

Third, each state also has a licensing board that has jurisdiction over hairstylists and cosmetologists. Each state calls it by a different name. Check in your state who to complain to. (In Massachusetts, for example, it is called the Division of Professional Licensure; New York and North Carolina call it the Board of Cosmetology ; Kentucky calls it the Board of Hairdressers.) All of them not only license these businesses, but can discipline someone for incompetence, or even revoke their license. Check out your rights in your state.

Yes, you could have been poisoned by this - and I hope that you went to the hospital to have it treated. Not only will you have received treatment, but you'll have medical documentation of your claims.

Most if not all states require licensing for cosmetologists, you should have reported her to the state cosmetology board, as well as your area's Better Business Bureau if you have one. She should not have left you alone, unless she had someone there to watch you and make sure that you did not have an allergic reaction.

Talk to a lawyer, they'll be able to tell you what the limit for damages is in small claims - since you were actually injured, the odds are pretty good that you'll be able to take it to civil court. They'll also be able to tell you whether you actually have a legal leg to stand on at this point.

Yes. Contact a personal injury attorney ( they advertise on TV and in the phone book and talk to you for free ) and explain your situation. Assuming that I understand you correctly, this is appalling and you should have medical treatment, and compensation for any work missed or inability to work or function fully. Good Luck.

A woman was on People's Copurt with the same thing, and she won. It would depend on what damages you are seeking as to whether small claims or civil.

She went to lunch and left color on your hair for an hour! That is so wrong! I hope you took pictures. You also need to see a doctor. I hope you take her to court. Good luck
