My boss keeps breaking the law, not giving me a lunch break, making me work every night from 1pm-10pm, and just not being a fair person. I had to have surgery so I left for 6 weeks, he was fine before that but when I got back he was bitter and giving me this whack schedule, I used to have the same schedule every week but now he scattered it around so I can never plan anything! Ever since I got back he's been a total jerk and I can't quit because I have bills to pay and no other job will hire me with the same pay I'm getting now. I would go to the district manager and complain but him and my boss are buddies.. What do I do??? And he's doing this to almost all my other co-workers!

I have to agree with SoCalSki. You need to go to your Federal Department of Labor or your BBB and put in a huge complaint and take documentation of him of not given you the breaks. He is definitely breaking the law. Just tell your boss out straight and put your foot down and be abrupt about it "I'M TAKING MY BREAK!" and if he refuses then put up a small fight with him and just tell him "YES!, IT'S REQUIRED BY LAW AND THAT YOU ARE BREAKING THE LAW IF YOU DON'T GIVE IT TO ME". You need to stand up for yourself and don't take that crap from him. Who cares if he's Donald Trump, BIll Gates, or George Bush, you need your lunch breaks and at least two 15 minute breaks. It's required by law. So don't let him push you around like that. Make a stand. He can't tell you not to take lunch breaks and other breaks. That is just ridiculous and unbusiness like and he knows that.

Then just report him and show your documentation that he didn't allow you. And I'm sure other employees around you can vouch for you also.

PLEASE LET US KNOW HOW EVERYTHING TURNS OUT. THIS IS A VERY INTERESTING CASE AND WE ALL LIKE TO KNOW YOUR END RESULT.

You should go to his district manager, especially if he's doing this to other people. I guarantee you that the manager's job is more important to him than his "buddy". If you file a complaint with him, he has to follow up on it. Your boss cannot work you for more than 8 hours a day without giving you at least a 30 minute break, and he has to give you overtime for each hour in excess of 40 per week.

Have you spoken to him about your problems? Also, I know that there must be some other job that you can find that will give you comparable pay. I suggest that you at least look. It can't hurt. In the mean time, don't compromise your work or slack off. It may be worth your sanity though to find something with a little less pay where you are treated with respect.

If what he's doing is illegal, start taking notes at the end of each day where he did something you think is illegal (like denying you a meal break). Then take that documentation to the department of labor.

The Federal department of labor may be a better place to go than your local one, but either way "whistle blowers" are protected by law from retribution - although your employer is likely to try and make it look like you're a poor performer after that to get you fired for "justifyable cause".

You'll end up getting back pay at Time and a half for the lunches you didn't take.

I was a victim of this a long time ago, but didn't know that I could do anything but quit and get another job. I wish I had complained before the statute of limitations ran out.

He can't break the law. I assume if there is a district manager this is a chain of some kind? Go to the District Manager. Very nicely explain why you feel you are being singled out for unfair treatment. Most companies have employee problem resolution programs. Check your employee handbook. The District manager has a boss too ya know. Most companies know it is better to solve this kind of problem in house than force you to get legal help. Remember to be calm and professional.

damn you are in a bind, but there is something you can do. Find out who is the district manager's boss, for everybody has a boss unless they have their own business. once you get this 411 call him or her anonymously and state you feel the need to call the news station and exploit this unfairness and the bosses are buddies. there is always away around a mountain the easy way you just have to look for it and be very careful. and by the way you can not let anyone, i do mean no one know your plan because people are like snakes if they feel threatened in any way they will attack even friends. good luck..

Find an agency outside of the business where you are working. Better Business Bureau is the first one that comes to my mind.
Explain to them just what you have told us. If the BBB can not help you, they should be able to steer you in a direction where you can get help.
It can all be done discreetly and kept confidential - your boss won't know who reported him.
I would think he could have to pay some heavy penalties and possibly removed from his job.
Then he would be in deep doo doo trying to get another job with that in his background.

Use your non-working hours to find another job with better hours and then give notice. You cannot change a rude person and complaining about him definitely won't help. The extra money you are making is simply not worth those types of working conditions and having no life outside of work.

If he's really breaking the law, you should contact your local Department of Labor to complain. Otherwise, you'll just have to go over his head and make sure you have a formal complaint on file.

listen hun... no one likes there job and no one is ever fair i dont mean to be rude nor harsh i've been through it and im still going through it... and hating it but i cant quit either cause i've bills too start looking for another job and then quit... if not then your gonna have to just keep your mouth shut and do the work im sorry i really dont mean to be hars here but ... in this life time if you wanna make a living.. it aint easy...lol but i suggest you start looking fror a job... if not then go to the human resources or so now you said that your boss's boss there friends now theres a 3rd person higher then both of them you can go to ;) have fun i feel your pain but lifes tough... gotta learn to get over it and just go with the flow :) take care of your self... hit me up sometimes and let me knwo how everything works out for ya alright take care..

If you go to my profile the top listed site has an informative article on workplace harassment and dealing with it. I would submit some form of grievance against this person so it can be mediated to stop any further harassment.
