Actually, in the private sector, there is no law. The only repercussion is that they cannot advertise to be an EOE employer. Also, if not qualified as EOE, they will not qualify for tax abatements, business grants, and other programs the feds have for businesses to take advantage of.

But, if a private business owner does not care about those sort of things, he/ she is allowed to hire, and not hire, anyone they choose.

**added** Actually, you didn't try to get hired at Hooters, as this has already happened. Hooters is EOE, and a man sued for not being hired to be a waiter. Hooters caved, and allowed him to be hired. On his first day, they gave him the same little shorts and top that the girls wear. He told them he didn't want to wear it, they should provide a male uniform. The told him they do not discriminate, and all wait staff, regardless of gender, wear the same uniform. He promptly quit.

It's the Equal Opportunity Employment law.

Basically, you can't discriminate against anyone due to race, sexual orientation, sex, religion, marital status, physical/mental disability, political affiliation, nationality. . .

Labor Law Standards prohibits an employer from denying a person because of color or race.

The equal opportunity in employment act states that you cannot hire based on race color creed or sex.

Dude! That is so wrong! I mean, they don't enforce it! Like, I tried to get a job waiting tables at Hooters, and like, dude, they like so didn't hire me!
