to deal with the creditors however I thought I had done my research on the company. (I did research on several companies and I guess this one slipped through the tracks) but when I went back, I discovered the company had many complaints against them.

Is there anyway to discard or null and void the power of attorney before they take any more money out of my account?

The power of attorney granted permission for the company to act on my behalf, not to take money out of my account.

Would a faxed letter saying I am null and voiding the power of attorney be sufficient?

Yes. Any power of attorney can be revoked by simply writing a statement of revocation. Your statement revoking the Power of Attorney must be notarized. Yes, you can fax them a copy. In fact, it's a good idea never to give an original copy of a POA to anyone. Make them take a copy and you keep the original. Say this: I,(insert your name and address), hereby revoke the Power of Attorney granted to (insert name of company) on (insert date of the POA you are revoking.) Take it to a notary and sign it in front of the notary. The notary will need to see identification and see you sign it. Then you're done. Fax it to the company asap.

Write a 'Revocation of Power of Attorney' ASAP. Have it notarized and deliver copies to your bank, and all your creditors. NEVER, EVER give ANY company that kind of authority again. If you must grant a power of attorney it should spell out exactly what they can do and explicitly limit their authority to what is spelled out.

You can rescind a POA at anytime, jsut by giving legal notice in writing. THE SOONER THE BETTER with these bastards, all these companies are a total scam.

I would also go to your bank and get a new checking account with a new account number first thing tomorrow morning!!

you need to see an attorney as soon as possible to get papers served to cancel the power of attorney and depending upon how much money they have deducted and what they did with it, sue to gt that money back. If you can't afford an attorney contact legal aid in your area!

I've never heard of signing a POWER OF ATTTORNEY to authorize automatic debits from your bank account. Usually this is accomplished with a bank draft form which can be terminated at anytime upon written request...if you run into difficulty, you can always close your bank account and open a new one...Best of Luck!
