would like to know if it is legal for an employer to only give it to certain employees

No. Because one person's cost of living is not the same as another persons. When i worked a second job a few years ago to pay bills at a retail store i was paid more than the others because i had more experience and lived farther away.

That's life if you have a marketable skill you have the advantage.

It depends on the state. Indiana labors law are generally written by and for employers. Employees are SOL.

He can do what he wants with his money as long as everybody is paid the legal fair rate.

i believe that it is, because the cost of living goes up for everyone every year
