Do I have any legal rights to keep the extra item ? How long should I wait before I can legitimately call it mine if they don't contact me to ask for it back ?

You do not have a legal right to keep an item that you know has been misdelivered. You probably have no duty to tell the people they have sent you an extra one, but if they find out and come after you your having kept it could theoretically increase the amount of damages. As to how long you have to wait until you can call it yours: again, in theory, it will never be yours, but a time will come after which they would have no right to sue to get it back. How long: depends on where you live. But probably 2 or 3 years.

Now -- the above is takling about the law. You can make your own practical calculation as to how long it is before you feel comfortable that they won't realize what they have done, and whether you'd feel comfortable keeping the thing.

But you may also want to make sure you haven't been charged or billed for two, If they mistakingly send you two, they could have mistakenly have charged you for two. And if you've kept the item, you don't have a good argument that you don't have to pay.

And you may also feel that ripping off whoever sent you two is wrong, and you want to let them know even if the law doesn't require it.

I'm not sure what you mean. You either got 2 of the item you ordered, both shipped to you, or you recieved your order and somebody else's - as in their name was on the package. Either way, you don't own the extra item.

However, if the second item was shipped to you, and not somebody else's lost order, they may just let you keep it. Call and ask. A lot of times it's too much work for them to cover the shipping back, etc. Even if it was somebody else's lost order, they may still let you keep it. Just call.

You do not have the right to keep the item. Would you complain if you ordered 2 and only got 1? If so, then make it right and return it.

No. This was a mistake, and you don't get to profit from it. Tell the company. If they say 'send it back' tell them you'll do that if they give you a prepaid voucher to cover postage. If they say 'keep it', you can keep it.

It doesn't belong to you - it belongs to them.

I would just consider it a 2 for 1 sale. If you used your credit card watch your statement to make sure they didn't double charg you.
