I have listened to people make similar cases for many years (more than 20). I know a few people who have attempted similar approaches and am aware of others. To my knowledge none have ever won in court.

It really doesn’t matter if there is any basis to their argument or not, they will not win under the current application of laws. It’s sort of like those who believe that the federal government has no constitutionally delegated power to enact laws relative to guns. Even though they can quote a number of court cases supporting their position, it isn’t going to change current application of governmental acts.

The singular process (short of revolution, which also won’t work) is legislative. If you believe in a position, then build a constituency, convince your elected representatives and change the law. Sadly, this gentleman will finally be captured and will serve long years in prison.
