Border patrol shoots and they get arrested?

Two border patrol shot and hit a man who was trying to smuggle pot into the USA. The guy was taken to jail in Mexico to await trial. Now, the USA has charged the 2 patrolmen and are asking the Mexican government to drop charges so they can bring him here to testify against the patrolmen. How screwed is that????

That's insane. Unless the shooting was unwarranted. Hard to tell with so few details.
