Why? because the voters voted on a proposal and it passed. While I am a smoker, I appreciate how those who do not have perhaps had enough and the timing was just about right for such a proposal, that is, more people have quit and there are more non-smokers than smokers.
With respect to their legality, there are many many products sold legally that can not be used in public.
I'm not so sure about following the money on this one, if anything these actions may discourage people from smoking thus lowering the overall income from cigarette tax.
