We reside in Georgia. We have 2 kids together but that was before the marriage. I am having a hard time finding the necessary info. I can't afford a lawyer. Any info, even a link to a good website will work. Thanks

Let me just add that I've come to terms with the decisions I've made and events that led to my situation and I would love for people who can offer advice and answer my question to respond. I'm not asking for smart comments (i.e. Steven P) from assholes who like to try to bring others down to make themselves feel better. Thanks to those offering real advice and answers.

In most states, a marriage can be annulled if either of the parties were physically or mentally incapacitated during the ceremony. If you are drunk, high or mentally unstable, the marriage can be annulled, meaning that it can be stricken from public record. However, if you simply want to divorce, that may be your best option. Most states now have Legal Aid, a program that can get you an attorney for low or no-fee (pro bono) basis. Check you local phone book or agencies in the area. Good luck and God bless.

Here in Washington state you can have a marriage annulled six months after the wedding took place. I think it differs from state to state. Call around. Call your local courthouse and ask when kind of paper work you need. I’m sure someone will help you. Start searching on the internet for info. I’m sure it’s not too late to end it.

Probably not, even an annulment requires a lawyer, I think a divorce is what you need. But better yet, get some counseling and make this marriage work. Get him off the drugs, and on the life.

Can you change a divorce to an annulment if the husband was mentally insane at the time of the wedding?

that's hard to say. to annul a marriage you have to assume a person what either deceitful, not in sound mind, etc. though your husband was inebriated during the ceremony, presumably he wasn't during the few days it took to apply for a marriage license, etc.

you'll have to get a lawyer to annul the marriage anyway, you can't do it yourself. you can try to file for a legal separation, and then later divorce. divorces in Georgia run as low as 300 (which is still a lot i know) if neither party contests it

In the State of Oklahoma, the time limit for annulments is 6 months. Here in this county, a lawyer is still required for representation.

Boy oh boy, you pick great men. Maybe you can have another kid. Give him the option of no drugs or alcohol or no you and the kids. if he chooses the booze, leave him.
