Ok here's the deal, I am fighting for custody of my kids ages 6 and 5. My ex uses and deals drugs for a living. He has no way of supporting the kids legally anyway. My attorney asked the judge for a drug test on both of us to determine whats in the best intrest of the kids. The judge issued it. I went straight from the court house to the place where we take the test because we were ordered to be there by 5:00pm. I passed mine. That was almost 2 weeks ago. My attorney hasn't recieved any results from the ex's attorney. He either didn't pass and they are hiding it or he didn't go. We have court on Friday the 19th. I am nervous. Not sure if this is enough to get the kids away from him. Also he lives in a 1 bedroom shack with his girlfriend her son and my 2 kids. Possibly more people.

If he didnt show up I think the judge will take that as him admitting that he is on drugs and it will look badly on him, so that works in your favor.

Relate all of the facts in this question to your attorney. He or she will know how to present your case. Nervousness in such a situation is normal (I am a trial attorney and have experienced nervous clients) but that will pass. Have faith and hang in there.

I don't know if its enough to get custody, but if he didn't submit to the test as ordered, then he is in contempt of court and THAT can be ugly. Judges do NOT like to be disobeyed or ignored. If he ends up going to jail for contempt, you will most assuredly get custody.

1. First of all, what's your question.

2. Second, just let your lawyer deal with this situation, that's what he's paid for.

3. You're asking a bunch of Yahoos to give you a response to a case they don't know all the facts and where most of us are unqualified to answer.

I know you're concerned, but I don't think you'll get much good help here.

I would think that the judge should ask him for financial info as well. pay stubs, tax returns, etc. If the drug thing isn't enough ask your lawyer about that stuff.

what is your question, you will know the results on the 19th
they will probably , give some reason for false positive test and make him retake it...in which he will probably pass it...or he masked his urine with formaldehyde and it can take almost a month for them results, because they send the urine all over the country to see what created the false positive !!!

If he didnt do it and the judge order it, he is on trouble, dont worry you will find out tomorrow and I bet you will get the kids. God luck!

Don't lose faith. Your kids will be with you because from your short question I wouldn't want him to take care of my dog. Hang in there and be strong for your kids.

wow how did he get your kids in the first place...sounds like u are lucky to be divorced now...good luck...and yes..I think u will get your kids...just don't shack up with anyone right now
