I hired an attorney 3 years ago for custody of my son. He was paid in full a month later. We have yet to step in court. I have contacted him about the case with nothing back. The last time I heard anything was in Aug. saying we would be going to court sometime after the first of the year. I have emailed and called with nothing in return. My son's dad is in prison and was living with his wife (who we were going to court with), but she shiped him off to Florida to be with his grandmother. I haven't seen my son in 3 years. I don't know the grandmother's name or even what part of Florida. I am so lost on how to file a grievance. Does anyone know and can help me?? What happens after you file one. We paid this attorney 5,000 dollars do we get it back? Can anyone help?

The single greatest cause of attorney discipline actions stems from a failure to communicate with their clients. You need to contact the State Bar Association and have them draw up your complaint against the attorney. The Bar Association will send a letter to the attorney informing him of your grievance. Generally, an official complaint will move the attorney to some action. If not, then you will have to find another attorney to sue the first one for malpractice.
I simpathize with your plight. I had a young mother lose her baby to the father's family due to legal kidnapping on the part of the father's family. The judge and opposing attorney both simpathized with my client but there was nothing they could do. We would have to travel from Calif. to Arkansas to fight the illegality of what the father did and nobody had the money to pursue it.
I hope your case does not end as poorly as that. Since you are the mother and presumably have joint custody, then you should automatically be granted custody while the father is being detained. The step-mother could be held in contempt if she fails to produce the child. She could be charged as an accessory to kidnapping if not outright kidnapping.

There are a couple things you can do: the first is to contact the licensing board of california and file a complaint. Second, call the Better Business Bureau-- they really won't be of any help, but at least you'll have the complaint on file with them. The third (and possibly the most effective) thing you can do is to contact a local advocacy group. Several community groups are available who deal with this kind of stuff on a daily basis and can advise you on what to do. If you live in San Francisco, you're really in luck as I think they probably have the most community services available in the bay area. Good luck!

But you have alot of variables with your custody battle that exist, did you have sole custody, that's a bit huge, did you have any limitations placed on your vistitation rights, any charges by FOC or FIA, you need to fully explain, instead of being digruntles with the attorney who failed to return your calls, you need to if the state grievance board will conclude upon investigation that he is in fact violated or compromised his obligations to the state as an attorney, did he compromise his own best interest and what he vowed to do, if you dont recieve the results you desire dont be psyched up about it, you may not have grounds for a grievance or you will you need to call. Moral turptitude, culpability etc...

Find another attorney that's willing to go after your 1st attorney (they usually won't ... it's a reputation thing in their profession... they protect each other) and work on your custody case.

Three years without any action doesn't seem right, but there may be circumstances that have caused action to be delayed this long.

Contact the bar association in the state where he is licensed and they will help you with a greviance.

wow I am so sorry..My attorney sucked as well I had to fire her.Fire your lawyer them sue him. There is people out there who will help you.
