I did something stupid and went to court for it but because i have no prior arrests they told me after 6 months of no wrong doing the charges would be dismissed. Its been almost 6 months. The problem is lately ive been trying to get a job and i cant when they do background checks would this show up. what i mean is, is the charge on there and it will disappear after the 6 months or is it not on there and when i do something wrong will it appear. i hope that makes a little sence

It depends on what was your sentence and the procedure in your jurisdiction (the city or state in which you live). If you were given a suspended sentence, that will probably be sealed after the six months. However, if you were given a probation sentence it might remain on your criminal record. You may want to go to the criminal court after the six month period to see a copy of your record and make sure the charges no longer appear. If the charges are still there, you may need to get an attorney to help you clear your record.

your problem lies with the data agencies that employer's use for background checks, which is totally different then the court system

the court system says after six months if you stay clean they will drop the charges and it goes away versus when you apply for a job and they ask if you have ever been arrested, your arrest since it was public knowledge is in the data base as you stated, and unfortunately they have no legal duty to withdrawal the information even after six months, since its true and public knowledge, only recourse is in future you can put down yes arrested bu t case was dismissed

Talk or call the court clerks office and find out if it has be ex-sponged after the 6 month period.
