Yes, it's a legal site, but, sometimes the video uploaded may not be. If the video is copyrighted, the person uploading that video is in the wrong. If it's a video that person made themselves, there is still a copyright on it, but when they upload their homemade video they agree to the terms of the website, making their video public.

It is legal, however, they do not do a very good job of censorship with their videos. Personally, I think that they need to take a good look at what they are allowing to be posted before they put it up. Also the agreement is only for the person uploading the video. If anyone in the video does not wish to be on there then they can take it up with youtube and try to get the video remove. Or they can simply sue the person who posted the video.

I don't much care for youtube as much as most people.
