I am trying to find help on getting a divorce my husband is in federal prison and he can get on for $120.00 he says but he won't do it and I have tryed to go to the local county and file but I can not due to him being in federal prison. I have also tryed legal aid and got no where. I can not afford a lawyer. So any help would be greatly appreciated......

I went to a bunch of questions with legal aid and they said that they do not do the divorces they send you to counseling. I do not understand that my husband is in federal prison no working our problems out I am also in Illinois. Does anyone else know of any other agencies that may help me out. I know there is a filing fee to pay and I am fine with that but just trying to get to that point. I can not go file it myself at the county they said at the county I live in ehich is christian county.

Well, the bottom line is money talks. If income tax season is good to you it's best to just go through a lawyer. If soldiers can do it from Iraq, then there has to be a way for you too. I went through the same thing while my ex was locked up and legal aid was useless for me as well. So I had to wait long enough to save up enough dough(which wasn't easy, being a single mother at the time) But when I did that I ended up paying a little under $400 and the deed was done. I don't know the laws where you are but most places require a period of separation first which can be anywhere from 6 mths to 2 years. I think the hardest thing is having to except that things can't move as quickly as you may want them to. But stay in the yellow pages and the classifieds. Divorce lawyers run specials all of the time almost like furniture sales. lol Also if you have people who know the both of you and are willing to write up and sign statements of any negative goings on as far as how he has treated you..that's always a plus. You get enough of those and it will be hard for any judge to ignore. Main thing, stay vigilant, where there's a will there's a way. Hope this helps. Good Luck Sweetie.

sorry to hear you are having a hard time. I am divorced, and did not have a lawyer. It still costs $$ but seems to go more smoothly. If you don't have children or joint property, you can usually find someone in the yellow pages that is not a lawyer but can help you file, then you will be ready. You are talking about $500, depending on where you live.

Why didn't legal aid help you? If you met the income guidelines they should be able to help you. I don't know what him being in federal prison has to do with it. If you met the residency requirements with him by living in one place for the required period of time, you should be able to file . . . at least in most states.

Talk to a lawyer and see what your options are for divoricing him in this situation... You should be able to get a no faulty divorce i would think but i could be wrong. you might have to get a part time job or full time and save up money for a lawyer and divorce or talk to your family or friends and see if they could help you.

lol, no I dot think so. The best thing to do would be to go and speak with a lawyer on the matter. They could give you the most accurate prices and best advice. I know that if there are no kids involved, then it sohould be relatively cheap

legal aid didnt tell you =why you cant depends on what state you are in if you are in florida email me and i can recomend a document specialis that can file papers
