No he does not have to supply her with a vehicle. They only way she will get the vehicle is if it is in both their names or he has two vehicles. If he has two vehicles (wich were purchased during the marrige) she will get one of them. Trust me on this, I just went through one myself. If she hasn't worked at all during the marrige she won't get a thing or a dime.

Well, there will be a settlement hearing to determine who gets what. It does not matter if the car is in his name. The court will determine who gets to keep it. My sister was in a similar case and she got to keep the van but she had to pay for it. BUT, child support and spousal support was increased to make up the difference of the car payment. So, he really ended up paying for it.
If this guy was any sort of man, he should give your mom the van and work something out so they can both afford to live seperately and still make the payments on the van. It would be the only nice thing to do since she will have to have a vehicle for the children. Good luck.

That will probably depend upon the judge in that area but she will get some money in the form of child support and she may be able to get ss disability if he is no longer there to provide support for her if she isn't already. Her divorce attorny should be able to help her in these area as well as with the divorce.

Depending on the separation agreement, he could be ordered to turn the vehicle over to her in name, and could also be told to continue making payments as part of the divorce settlement, but not necessarily, depending on her ability to provide income.
