Why do I feel this is a loaded question??? Having said that, I will answer.

The liberals, socialist, and terrorist living among American citizens would have you believe that these people are criminals. They would ask you to treat them as you would a pedophile rapist and murder. I.E. "rehabilitate and release them as soon as possible. These people would ask that they be treated better than their victims, be afforded legal representation, allow them to reveal classified information in open court, allow them all manner of due process then lock them up in a Federal Country Club somewhere that they might spend their weeks of incarceration playing golf and perhaps sharpening their aim. This is simply balderdash in it's most blatant form.

The US Constitution does not apply to these people; they are not American citizens. The Geneva Convention does not apply either; they do not comply with the terms defining enemy military forces.

They are enemy combatants; they are being detained in what amounts to a prisoner of war camp. They were removed from a battle field, disarmed and incarcerated. These combatants are exactly where they should be.

So they have no Miranda rights, no rights to a speedy trial and no rights to a plane ticket home along with any weapons they select from the arsenal of their choice.

Gentlemen and Ladies, this is WAR, if you care to treat it as a policing matter you will have another Korea or Vietnam. Micromanage it, play nice, be touchy feely, fight fair and believe me this will be every bit as bad as anything you might imagine.

These terrorists have plotted or assisted in plotting to carry out attacks against my country and my countrymen. Even if a terrorist threatened a pansy that wants to apply rights afforded to US citizens to terrorists, I would still hope that that terrorist only leaves Gitmo in a coffin. I also feel the same about any terrorist that threatens our allies, lock them up and throw away the key.

Murkglider: What planet do you live on? Terrorists are not prisoners of war. Soldiers are prisoners of war. Terrorists are enemy combatants. A prisoner of war is not the same thing as an enemy combatant. Prisoners of war have rights under the Geneva Convention. Enemy Combatants do not.

The detainees at Guantanamo are NOT US citizens, subject to the US Constitution and its Bill of Rights, nor does American law apply to them. Nor do the Geneva Conventions, because they are not POWs.
These people are enemy combatants who were fighting our soldiers on the battlefield.

They are being treated humanely, live in clean conditions without fear of torture or death, and will be released when the conflicts are ended. Being kept safely out of the conflict for 5+ years does not constitute miscarriage of justice.

Where does it say anywhere in anybody's jurisprudence that our government has to play "catch and release" with armed insurgents whose life's goal is to kill Americans and die a martyr's death?

Unless the detainee is a citizen, the constitution does not even come into this.

What do you think about imprisoning innocent Americans and slowly, not swift and quick, cutting their heads off on tape so their families and all of the whole world can watch????
