Where appropriate, a court may award summary judgment upon less than all claims, known as "partial summary judgment."

That is your answer to a very difficult to understand issue. Essentially, there is an issue before the court. Both parties of the issue would, of course, like to win their case without appearing before a full trial. A judge issues a ruling based upon the facts presented before him without going to trial.
