It cost me £390, she didnt have a paypal account so I sent her a cheque. I have since heard nothing from her, she doesnt reply to my emails. The police have said it is not a police matter because I bought it off ebay and they have their own way of dealing with such things. The thing with Ebay is, I will only get about £100 of that back. We have her address and my husband wants to go there and try and sort it out. I am so frustrated with the police as how can theft of money not be a crime? What should I do? I really do not want her to get away with this but at the same time, I dont want to get into a situation where we have taken it into our own hands and end up getting into trouble with the police!! Sensible answers only please as I already want to go to her house and rip her head off!!!

The cheque was cashed 2 days after I sent it. She must have an account with the same bank as me and no, the bank will not take my money back out of her account or give me any details about her.

You may be able to go to your bank and report it as fraud. I have actually done this and the bank can reverse the charge from your account and credit the money back to you. You might have to close the account, though, to prevent any further access.

She should have a telephone number registered with ebay, with you should have received with her address in payment detail section, have you tried that? Also, perhaps write a letter (sent recerded delivery) to the address you sent the cheque to, to ask her as the cheque has now been cashed and you cannot get hold of her via ebay, when can you expect delivery of the item. Tell her if you don't hear from her within 7 days then you will start proceedings to recover the money. Try and keep your cool in the letter as getting nasty will stop her co-operating with you even more.
That was a large amount to send via cheque on an ebay purchase, I guess it's too late and obvious now to tell you it wasn't a good idea and the safest way for large sums is via paypal, she could have set up an account in minutes if she was serious about taking your money for the sale.

Cancel your cheque if it's not too late, let e-bay know aswell. E-mail her and tell her what you've done. However if she's taken the cash, give it a week or so for postage etc and if nothing develops go and visit her, take a video camera with you so that you can record it all, in case she goes to the police and says that you were harrassing her. I think you should talk to the police again after all you have given her a cheque for £390 and she has not given you anything in return so effectively she has obtained money by deception (I think!)
Good luck, and if this has not turned you off and you still want to do business on e-bay make sure you buy from a seller with paypal.

If she left ebay and if ebay gave you back some money, then they are stymied also by this person? If you live near her, maybe going out there to discuss the matter is your only choice. I don't know why the police don't get involved, but when a con artist boyfriend took me for a lot of money, they let him get by with it also. Said I "Gave the money to him"....even though I had an IOU note to pay back the money from him. Guess they have too many more serious crimes to deal with. It still doesn't seem right. It is fraud. You could sue her in small claims court and then maybe somehow attach her wages or bank account??? *I am not an attorney*
What I did was pray for God to deal with the person who cheated me. God's arms are not to short to reach them and bring justice, nor too short to help you.

Yes you have been scammed, and probably a lot of other people as well, if you have her name and address and you are sure it is correct (it must be if you posted the cheque) publish her name and address on here or anywhere, shame the b!tch, first write her a letter telling her that you will publish her details if she does not return your cash, and if she sends back your money, publish anyway, good luck and don't use EBay again.

I'm presuming its already too late to cancel the cheque. Go back to the site and give her the most negative feedback you can. People really dislike this.
Then, email Ebay again, or even ring them up directly. Its THEIR site, but I don't know if they're directly responsible for the sellers. The last thing you want to do is go to her house and try to sort it out... it could lead to assault... prison...
Its not a police matter either, it should be sorted by Ebay, but, like i said, I'm not sure if they're responsible either...

I am so sorry that this has happened to you, if the cheque hasnt cleared then contact your bank and cancel it asap. Otherwise get back intouch with ebay and speak to them about there refund policy as I cant understand why you have been told you will only get £100 pounds back. If this fails then if you have her name and address then you can try and find out about taking legal action against her by raising a small claims case against her with the civil court. Keep all your emails and other correspondance regarding this as proof, good luck

Have you considered that the address might not be genuine? Sounds like this person knew what they were doing, and therefore will probably be very difficult to trace.
I can see why the police are not very interested. If you choose to send someone a cheque, then that's up to you.
It's horrible that there are people like this in the world, but it might be best to just recoup what you can and put it behind you.

The last thing you want to do is go to her house. File a complaint with Ebay and leave her negative feedback. Make sure in the negative feedback you briefly explain your complaint. You only get about 10-15 words to do this. Try: Don't trust this Ebayer!Money never refunded. People need to know about her and why you are leaving her bad feedback. Take it as a lesson to always buy from Ebayers with Paypal or credit card. I know this is useless to you now but we all live and learn.

Complain strongly to Ebay. If she is no longer a member, negative feedback will have no effect.
You could then take her to the small claims court, but she may not even pay up then, worst that can happen there is she will get a CCJ.
Complain to your bank and tell them you are seeking legal advice, then get in touch with your local CAB and see what they recommend you do now.
