I live in Texas and married a illegal in 20001. I want to divorce him but don't know where he lives. He was born in mexico and came over here illegally 16 years ago.He went to H.S. in Texas but has no social security card ,driver's license/ID or any form of ID. Only know his place and date of birth from marriage certificate. How can I divorce him? And will it cost more because I can't find him?

There really is not a problem about your divorce. Your attorney will have to satisfy a judge's question about due dilligence when the matter of notifying your husband of the divorce action comes up, the question can be easily satisfied when a notice of your filing for divorce is published in a newspaper for a certain period of time. It will take a little longer than normal and because time needed for the publication, and it will cost a bit more (shouldn't be a lot, just the cost of publishing notice of filing), and then, the divorce proceeds normally.

If you have children, you MUST use an attorney in order to be certain that a child support order is in place. I know you don't know where he is now and it seems like a lot of fuss over something you can't get right now, but you'd be surprised how people have a way of turning up again. If you have orders in place, you can make him a happy present of his child support and any back money that the judge orders him to pay at the time of your divorce. Might come in handy, you never know.

In some states they might grant you a divorce because he abandoned the marriage.He may also have used another name so that might be hard to fine him either way. You can check with an attorney ,you can get consultation for free, just to fine out enough information on what you need to do.You can call the court house as well see if they can point you in the right direction. i dont think that your marrage is legal anyways since he was not legal in the US. YOu best bet is to talk to a lawyer for family law and see what you would have to do
