My girlfriend just filed for seperation today and the lawyer told her she can do it 2 ways legal which would have cost money or the other way free, so she chose that way, and he told her in a years time she could come back and get the divorce. But i thouhgt it had to be a legal seperation before u got divorced.

No that is not the case if you are not living together and having no sexual contact between the two you can file for a divorce in a years time depending on which state she lives in, some states you can get a divorce in 3 to 6 months depending on what kind of conditions they are filing a divorce under for example irreconcilable differences, or physical and mental abuse.

No longer necessary. I havent heard of free divorces if youre seperated over a year anyway. As long as you meet the residency requirements of the state in which youre filing you can file immediately. How you do it is dependant on your finances and if you can afford an attorney or contact your local legal aid assoc. for advice. Good luck

No, you do not have to have a "legal separation" before getting divorced.
What the lawyer says does not make any sense to me. One way is free and one way is not? That does not make any sense.
Is the spouse of your girlfriend gone and no one knows where to find him? If so, there may be a little longer waiting period.

You do not need to be legally seperated to file for divorce, and my advice is to hire a attorney to protect your assets.. The minate you try and do it yourself someone is going to get screwed.."better them than you" It is always worth the extra cash in the long run!!

U have to look at the laws by which ur marriage is governed. Legal separation is not a must in all societies.

In Indiana, one can file for divorce any time they want. No separation is required.

You gonna allow an outside source tell you when you can get a divorse thats horse ****. i walked to the car then to the lawyer and it was over in a week after she fessed up she still wanted to sow wild oats. ah yup i put the alley cat back out. and moved.
