Hussein, along with seven other defendants, was tried for allegations of crimes against humanity with regard to events that took place after a failed assassination attempt in Dujail in 1982.
A second and separate trial began in August 2006 trying Saddam, along with six other co-defendants, for genocide during the Anfal military campaign against the Kurds of Northern Iraq.
The sentence was death by hanging for his part in the murders of those people, who lived in the town of Dujail.
He was given the death sentence because in Iraqi law it is legal to sentence someone to death if they have committed very serious crimes.
I've also heard that the people who attended the hanging of Hussein were all Shiites because Hussein was the Sunni leader. They were all chanting the name of the leader of the Shiites during the execution. I can't remember the name. I think Sadr maybe?

Saddam and six of his former aides were charged with crimes against humanity over the so-called Anfal campaign against the Kurds in the late 1980s, which human rights groups say left more than 180,000 people dead.

Because he was convicted of the non judicial murder of his citizens. That is the legal reality. Another reason is as long as he was alive he would continue to be a focus for a " Baathist" revival. Thirdly he was hung for revenge. Revenge is the ruling motive for any murder in Iraq. It is that countries cultural response to any injury, real or imagined. look up "Baathist".

He was judged, sentenced and executed in a hurry so that the judgment could not go on and expose the western (US, French, Brittish, etc) involvement in his crimes (his support against the regime of the mullahs, the selling of chemical weapons, etc).
