think of it in this sense: if a tree falls down in the woods & no one is around to hear it, does it still make a sound? ...well maybe it does, but what is sound without someone to substantiate it.

I think there's two sort of powers that regulate and decides ones behavior;
The Law; which is supposedly be put to fulfill people needs in security, justice, etc,
Self Consciousness and ethics; Every one of us has it and has his own voice who tell him to do or not do certain things, and this vary from one person to another, some people keep justifying to themselves certain things that normally people condemn.
so, to answer your question i d say that if you could over run the other power (conscious and ethics) in you, then your statement is absolutely true; it's only illegal only if you get caught.
