I recently handed in a one week resignation letter to my supervisor. A few weeks later I noticed that on my paystub I was paid minimum wage for 40hrs. I then asked my supv what was going on and he said since I failed to give a two week notice, it was company policy to pay minimum wage. Is this legal?

I was with a company that did that to me, and it was in all the papers I signed when I became an employee of that company to begin with. So yes, as long as you signed a paper (somewhere) that says that, it's completely legal

No, it isn't. I suggest you take your last few paychecks to your state Board of Wages and Hours and file a complaint. I would imagine that no one's bothered to press the issue. If you agreed to it in an employment contract it may still illegal based on Unconscionability. Talk to your state Board of Wages and Hours and consult with an attorney.

Your rate can be reduced by the company with or with out your consent depending on which state. Its a very petty thing for the company to have done though.

Do you have an employment contract? Was it mentioned in the union contract or in the personnel policy?

If it is in your employee handbook...(read the very small print) then it is probably legal. If not, then you may want to investigate your options..but be careful not to spend more than what they owe you trying ...because they will probably just cut you a check before they fight it in court...but it will cost you much more forcing that action. I would go to small claims if anything......after reading the book cover to cover to cover my ***...ets

Unless you agreed to that stipulation when you hired on, the company can't change your pay scale without your agreement.
