My friends girlfriend is pregnant. She admitted cheating on him and the time of conception was when he was out of town, so he's pretty sure it's not his baby. He doesn't want to have anything to do with her, but wants to be supportive of the baby if it is his. She said she is going to give it up for adoption as soon as it is born. Can she do that without his consent ? Can he force her to get a paternity test done so he can at least have a chance ? He would like to raise the baby if it is his, at this point he doesn't have any rights. If he just automatically signs the birth certificate, then he may be forced to pay child support for 18 years for someone elses child. Serious answers only please !

Your friend is very smart for not automatically signing the birth certificate without proof. That binds him 50% to the child. Yes, he can seek out an attorney to take legal measures for paternity testing. The court may require him to pay for it up front, but his lawyer may be able to make it where she will have to reimburse him for the cost of the testing if the child turns out to not be his. Also, she can not put the child up for adoption without the consent of the father if known. However, I'm sure if he is there saying wait a minute the courts will have some legal obligation to let him see if he is. Worst case scenario...he'll be out about $100 but at least he will know for sure one way or the other. Good luck.

SHE can do whatever she wants with the pregnancy because it is HER body. He can not force her to have a paternity test on the child because if she signs papers for adtoption before the child is born it will be out of her hands anyway, and there is no way to determine paternity until the child is born. If the child is placed at birth there will be nothing he can do about it because he will not be able to force the adoptive parents to get a paternity test either. If he doesn't want to have anything to do with her then he shouldn't be so hell bent on proving this child is his. He should just move on and leave it as it is now.

He should get a lawyer, i believe he can force a paternity test when the baby is born to keep her from being able to adopt the baby out.. and if paternity is established then yes she would need his consent to put the baby up for adoption.

Your friend needs a lawyer. Yes, he can demand a paternity test, and yes, if the baby turns out to be his, he can stop an adoption if he puts up his hand to raising the child himself. But as I said, this will have to go through court, so he will need a good lawyer specialising in family law.

He needs to make sure a paternity test is done after the baby is born... If she refuses he needs to take her on the Maury show! He will have to pay child support if it is his that is why this paternity test will be very important....

Each state generally has a birthfather registry, he should find out and register there if there is one. His rights need to be terminated in court before an adoption order can be granted. He could findout when the trial date is and appear.

If she does decide that adoption is the best option for her, I would really like to talk to her. I am an adoptive Mom of one, and am hoping to give him a little brother or sister. Please feel free to email me with any questions, or pass my address on to your friend.

I truly hope things work out well for them.

Take care, Jenny

That girl already admitted she cheating on your friend and he also pretty sure that the baby not his. So don't bother to care about the baby any more. And of course she can do anything with the baby, without your friend consent. My advice to your friend, leaves that girl.Find other one.
