is there any place that she can call or website that indicated if she is divorced? could she still be married? she never signed anything or went to court (since the divorce my dad has remarried)

When I got divorced neither of us went to court. The courts did it on our behalf (australia) - you could always call the court to ask, but they mightn't be able to give you information. Ask your mother...
If your dad has remarried, then the divorce must not have gone through. These things are checked out before marriages go ahead. You can't be married to two people - so relax, I'm sure the divorce is through.

If both parties sign all the papers in front of a lawyer, he will submit the papers to the court. No need to go to the court yourself. The divorce papers are filed in the county court house. You can go there and check it out, either free of charge or for a small fee.

If there are no papers there, they are legally not divorced.

You don't have to go to court to be divorced, I believe if both parties agree. Or if there was a court date and the person doesn't show up, the judgement is in the favor of the person who did show up...usually. You know, you can get a divorce on the internet for $50...you don't have to go to court for that. If they say they are divorced, and your dad is remarried, believe them!

if she signed the divorce papers i believe that means they are divorced after they approved by some legal people. i do not believe both parties need to appear in court unless there are issues that need to be worked out by a judge.
also if the marriage was annulled that is a whole different story which does not involve the law quite in depthly as a divorce.

One doesn't HAVE to sign in order for there to be a decree of divorce. Your mother should have been served papers if your father filed for divorce. If she CHOSE not to "answer" and respond to those papers then your father was probably given a default decree of divorce, which would not require your mother's signature, or a court appearance. I suggest she check the court recorsd of where you father lived when he got the divorce.

You don't need to go to court to get divorced. Your attorney usually files the papers for you. However, both parties must sign the papers to make the divorce actually go through. She should go to the court house and see if anything was ever filed.

Is it possible he could not locate her when he was trying to divorce her? I had a friend that was divorcing her husband but couldnt find him to serve him divorce papers. She had to go through some extra steps, but she was able to divorce him. Your mom should start by calling the county courthouse to see if there is a record of it. They will be able to give her a copy of the divorce papers.

If yourdad remarried then he either got divorced or is a bigamist and can go to jail. Check court records where it occurred

yes you could go to your local police depearment and find out who to go to and how to find out i don't knwo exactly but yes i'm sure she still is considering she did not sign anything and did not go to court. Does your dad or your mom have a copy of the devorce papers? If you dad does not have a copy then it's likely that your parent's are still married.

When I got divorced, I went to court, but my ex did not. He did not sign anything either. She could check the court records to make sure it went thru.
