why do i keep hearing that robbers can sue you if you shoot at them when they are stealing you things? i live in texas...does it apply here as well? i also hear that it is better to shoot to kill in these instances....if the robber can sue you, then wouln't you killing him be counted as murder? >.< why do we give such liberties to theives!??! this only further incourages them!!!!

yes in certian case,, every syate has many dif laws, say you runa crook OUT of your house and chase him down for 5 blocks then shoot him in the back, the thief is running AWAY hes no longer posing a threat to you hes out of your house, f and just because he broke into your housethis does not give you justification for shooting him, why? because he is no longer a threat to you or your property. but say he is advancing towards you in your house then BANG shoot that sucker D-E-A-D.

Luckily Florida recently drafted legislation that makes it fully legal for me to shoot at someone trying to rob my place, regardless of whether or not they are armed or trying to physically threaten me.

I can walk up behind them, put the gun to their head and pull the trigger.

Many other states have initiatives on the ballots to also bring their laws in line similar to Florida's so people can actually protect their property without stupidity like a robber suing you for being shot at while doing a robbery.

It depends --

in general, you are not allowed to use more force than is reasonably necessary to protect yourself or your property. For example, if you catch a robber and draw your gun on him, and he stops, you are not usually allowed to shoot him anyway, after he has stopped. The law varies from state to state (and country to country) and some states create a stronger presumption that the property owner is acting reasonably when he or she shoots the burglar.

Whoever is telling you it is better to shoot to kill rather than wound is completely wrong if they are saying it for legal reasons. For one thing, even if you kill someone, their family could sue you if the person could sue you. For another, you are much more likely to be charged with a crime for killing someone than just for wounding them, if the police and prosecutor don't think you acted reasonably.

Why is this the law? Because while we think robbery and burglary are wrong, in general we don't think simply stealing from someone is worth giving them the death penalty.

Texas has its stuff together!!when you shoot a robber dont leave him to come back and sue? send him on to the big blue yonder!but be sure he has a weapon in his stealing hand!

live in n.e. pa. my dad was a deputy sheriff...he walked in on a robber in our home..pulled his gun and shot over his head as the thief was running out the back door. he called the police.....tried to shoot as the robber was running thru the yard too.!
when police arrived, they told my dad......"good thing you did NOT shoot and hit him.....he could have sued you!" it seems the law stated that my dad would have to be in OUR OWN HOME before the robber?/ since the idiot thief was there first, you had to announce you were going to shoot him? sure makes NO sense to ME!?!?! stupid lawmakers.....their house should be robbed!

this is another instance where you shouldn't mindlessly believe anything you read in the news. in this country, you really only have the right to harm or kill another person if their actions make you do so unless if by not doing so you risk harm or death to yourself or others. clear as mud, ain't it? if someone wants to take property from you, you can't kill them, or try to. if someone tries to kill you or another, then you probably can kill them instead. unless they try to run away. clear as mud, ain't it? all i can say is i hope nothing bad ever happens to anyone i ever encounter or don't know. clear as mud, ain't it?
