if someone piggybacks your unsecured connection - are they a criminal????

Legally, it's a "grey area", but there have been cases where people have been successfully prosecuted.
It really depends where you are... you don't even tell us what country you're in, so it's hard to answer, really.

It's probably best just to secure your network...

by not securing your access point your facilitating that act.

if someone used an unsecured connection here, it is very hard to claim theft.

Not in the US. If you secure it and they hack it, they are. But it is extremely difficult to identify the person who is hijacking your connection.

I think you are suppose to secure your connection first but if someone does that afterwords yes they are then.

they are in as much as they are not paying for their own connection - difficult to say who they are thieving from except that as they are piggy backing your line - I guess they are stealing from your provider.

Depends on your countries laws, but usually it is illegal.
