Religious freedom is protected in the USA because it is considered by many in Western nations to be a fundemental human right. It is also a guarantee by a government for freedom of belief for individuals and freedom of worship for individuals and groups. Freedom of religion includes the freedom not to follow any religion (irreligion) and not to believe in any god (atheism or agnosticism).Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship, and observance.

Yes, it is a very firm Constitutional right, First Amendment, which states: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof . . . " Quite clear and quite obvious, right?

Is anything ever that simple in law? Of course not. Ever since the day it was signed, lawyers and judges here and there all over the country have been hammering away at exactly what it means and does not mean. But the Supreme Court has generally had to acknowledge a more open interpretation over time, as people of different religions and traditions have basically forced the issue of whether or not a particular local law was in violation of the First Amendment.

Where there has been injustice, much has been done. Much remains to be done, but Public Interest Law has gotten very good at certain areas, and freedom of religion is one of those that is really a fascinating study for the amateur legal historian.

I am aware that there are various battlefields in the area of fundamentalists vs. Darwin, and so on, but I hope that's not what you are talking about.

Presently the way the courts are moving is to protect people from religion... I have a greater right to not practice religion than I have right to practice a religion. THE original lady to preach agnosticism was Madolyn O'hair
