Actually in many communities nowadays what your NEIGHBOR is doing is illegal - having a public unsecured wireless connection available.

If your neighbor has left his wireless network unsecured, you are right it's free. However the caveat is that by connecting to an unsecured wireless network, you are at risk of being hacked. The right thing to do would be to let your neighbor know and offer to secure it for him if he lets you stay on board. Thats a win win situation.

Even though your neighbor may not be aware of you doing this the answer is yes. People have gotten in trouble for doing exactly that. It is rare though. Currently legislation is being drafted on this. Best bet is to ask your neighbor if you can share the service if you help pay part of the cost.
