You will need a letter from the father (the non-custodial parent).

Note: Canada no longer adds a child's name to a parent's passport. Canadian children now have their own passport. However, old Canadian passports which have had a child added before December 11, 2001 have been 'grand-fathered'. The passport is valid for both parent and child until it expires (or until your child reaches the age of 16).

If the child is already on your passport you may get away with it as who is going to ask if you are separated.

However having sole custody does not give you sole right to remove him from access by his father. I presume he has visitation rights or some aspect of access? If so he can contest the child leaving the country.

If you are applying to have him put on your passport then you have to declare separation and produce the form showing sole custody and have also a letter of approval from the father of the child. this will be followed up by the department to ensure there is no fraud or deception.

I have never required permission from my childrens' dad to go to the United States with them. Just make sure you have proof that you have sole custody (original court documents) in your possession when you go through customs.

Also, make sure to contact a consulate/embassy of the country you are going to to make sure they don't have any laws against only one parent entering their country with children.

Yes. In most every place you must get the consent of both parents because signatures are needed for the passport.
