I have civil restraints against my ex - he emails tirades full of curses and disrespectful talk, speaks hatefully to me, calls me stupid, etc, call my home at all hours.... my lawyer says this won't convine a judge he is harassing me.... what would?

I would suggest you consider a different lawyer!

In my state "harassment" occurrs when:

A person commits the crime of harassment if, with intent to harass, annoy, or alarm another person, he or she either:

a. Strikes, shoves, kicks, or otherwise touches a person or subjects him or her to physical contact.

b. Directs abusive or obscene language or makes an obscene gesture towards another person.

(2) For purposes of this section, harassment shall include a threat, verbal or nonverbal, made with the intent to carry out the threat, that would cause a reasonable person who is the target of the threat to fear for his or her safety.

A person commits the crime of harassing communications if, with intent to harass or alarm another person, he or she does any of the following:

a. Communicates with a person, anonymously or otherwise, by telephone, telegraph, mail, or any other form of written or electronic communication, in a manner likely to harass or cause alarm.

b. Makes a telephone call, whether or not a conversation ensues, with no purpose of legitimate communication.

c. Telephones another person and addresses to or about such other person any lewd or obscene words or language.

Nothing in this section shall apply to legitimate business telephone communications.

So you can see there are Harassment and Harassing Communications!

BEST THING you can do is get his harassing telephone calls recorded. It's worked on every case I've handled concerning this type of issue. Your ex can't dispute his voice on a recording! Judges love it!

You should check your state laws concerning this issue and then contact your local police to file a complaint and warrant for his arrest!

Get yourself a new lawyer he does not know what he is talking about.

Depending on what state you live phone records, email records, printouts and witnesses are more than adiqute to compel a charge of harassment on a person.

save EVERYTHING your ex sends to you, when you get you phone bill KEEP IT and highlight his number and amount of times he has called you. THAT is evidence of harassment.

Make sure in the restraint against your ex you have this written in, that he cannot contact you either. If not, have it amended.

You have the right to feel safe.

Verbal abuse, threats, vulgarity, obscene phone calls and threatnening emails can be harassment. Wait for it to continue, then you may want to think about filing charges.

Yeah that's totally sexual harrassment. Talk to human resources, but first, I'd ask the guy what the hell he's trying to do. Put him on the spot like that and maybe it will stop on its own without all the paper work. But if it continues, get HR involved.

what about calling legal authorities - adult protective services, animal welfare, etc. when there is no justification? Handicapped individual no longer wants contact with other family members because of their behavior - because of that they are contacting authorities supposed for welfare checks - however - it is I am sure because he does not want contact and they are twisting it to be that I am keeping him from contact,.

Obscene touching, showing your private parts, farting in public, shouting bad words like *****, niggger, black ************, etc., pulling your pubic hair in public, rubbing aginst your buttt when standing in a ling line, following you after work, talking so near that you can smell the stinking breath.
