Someone I know worked at a chinese restuarant and although they paid her more then the going rate per hour the owner kept the tips. I told her that customers leave the tips for the service not the owner. If I found out that a restuarant was doing that I would not go there again and I might say something not nice to them too.

If the waitress is paid at least the full legal minimum wage, the restaurant owner may legally keep the tips.

The only time that wait staff are legally entitled to the tips is if they are paid the discounted minimum wage, often as low as $2.65 an hour.

Many restaurants have discovered that this substantially eases the bookkeeping chores, payroll tax calculations, etc.

At the Chinese restaurant I go to, there is a bucket for tips on the front counter. At the end of the night, it is distributed evenly between all the employees that worked that night.

Your friend may want to check with the state labor board (EEOC) for more information.

I know the waitresses have to report how much tips they get cause they have to get taxed on them. I believe thats how it goes but they should get some of there tips back.
