After a marriage is dissolved in divorce, the ring(s) stays with the wearer(s).

However, prior to the marriage, if you break the engagement the contract), you are obligated to return it since you broke the promise (contract).

Legally, an engagement ring is similar to a refundable down-payment for a property. If you cancel the contract before the delivery of the property or service, the down-payment is to be refunded.

Likewise, if refuse to get married, the ring is to be returned.

Imagine the opportunities for abuse if this weren't the case. A few unscrupulous women might be tempted to accept a marriage proposal that she did not want, get an engagement ring for the purposes of sale, break the engagement and then sell the ring.

In Michigan, he has legal rights to get the ring back because it's considered a contract between the 2 people. Unless it was given on a holiday (Christmas gift, Valentine's Day present, etc...) or a birthday, and then it's considered a gift and the girl can keep it. At least that's what my brother-in-law says and he's a police officer. I'm not sure about other states though. Personally, I think that if the guy ends the relationship he should let the girl keep the ring. If the girl ends things, she should give it back.

As long as the ring was not given as birthday, Christmas, Valentines gift...yes, you can get it back. It was given at a random time then just like the other guy says it is a contract. If the contract is broken it is null and void.

If he breaks it off, you get the ring.

no not if he broke the engagement . if you broke the engagement then yes you should give it back to him . Someone on here asked why you would want to keep it ? It is a piece of diamond jewelry right ladies and a lady can never have too much diamond jewelry . :)!

He may unless it was given on a holiday then she can claim it was a gift and it is legally hers. This is something I heard people say before, I don't know exactly how true it is, if you really want to know, call a lawyers office.
