i live 4 hrs away from him and he never collects the children and always expects me and his mother to do the driving for him to see the children every 2 weeks, i am not prepared to do this anymore as its getting too much with my job and schooling,he is now threatening court proceedings.will he have aleg to stand on?he lost his licence last year for driving with the kids in the car without insurance and having an accident and has not payed maintenance since he left 2 years ago what do i do?

Tell him to go find a good lawyer- He is a deadbeat that doesn't pay you, doesn't pay his bills, and is unsafe to have your kids with (because he could end up in jail at any time), and you don't see him as a responsible person. I can't imagine why any family court judge wouldn't love to give this guy any preference!

When he wants to see them, he will come. You are tired of the drive and the cost of the trips!
You will have to explain to the kids about the divorce and how there isn't as much money or time to make the trip and you should explain that some people just aren't as responsible as others, and that their father just isn't making some very good choices right now. Try not to trash-talk him. The kids are going to be let-down enough.

What is the original child custody and visitation order from the court? It may have to be modified to fit a changing situation. Ask for sole custody of your children ,have your mom as a legal guardian of your children, give him visitation rights, supervised until he gets his head together, in meantime you concentrate on the job that you have to do. Let him threaten all he wants, make sure you do your part first instead of talking about it.

He wont get JACK! You sound like a good mom, you need to take him to court to get child support and proceed with visitation. Visitation with joint custody is every other weekend, and you two take turns on delivery and pick up of the children.

Well if he threatened to go with court proceeding, you should also do the same to him for not paying maintenance. If you don't do this to him, he will always push his luck and it end up you will suffer more

Let him take it to court. They will probably rule that you share the driving for his visitation with the children.
