In NJ, the Prevention of Domestic Violence Act of 1991, or NJSA 2C:25-19, does not include in its definition of a victim of domestic violence that they be members of the opposite sex. So, yes someone can be charged with a crime under the Prevention of Domestic Violence Act of 1991 for committing a crime against a person of the same sex.

The United States Code, more or less, says the same thing. Only in the armed forces, by Dept of Defense's legal definition, are crimes against the same sex not considered Domestic Violence.

So you logic is flawed since "two gays beating on each other" is still domestic violence.

How's it justice? Now, if your dad beat your mum while she was pregnant with you to prevent another idiot being brought into this world, THAT's justice.

And, uh...to rockinrobin down there, know your law. Technically, "two people beating each other" does not constitute assault since it's consenual. Cops and security officers (if on property) can charge them with prohibited activity on property (some places, that would fall under a tresspass statute). Only if one of them gets seriously injured can you charge them with assault because neither of them "consented" to serious bodily harm.

Just like Matthew Sheppard, right? Because you don't like a group, violence against them is OK? This us v. them mentality is counterproductive to society and antithetical to being a human being.
And if you hold these beliefs, why "ask" such a "question" here? To stir up more anti-gay sentiment? To prove you're a manly man?

No. Technically, no two people beating each other is ok. Domestic Violence is domestic violence no matter who is involved!

That's funny. seriously though in California if you are just arguing (no hitting ) and the police are called , one of you are going to jail. Period.. It is called a terrorist threat.

if you live in the same house with someone and assault them - it is domestic abuse - regardless of thier sex
