Myself and other tenants of my complex have learned that they are going to began construction right in front of our common area to build a pool, gym and so on. this area leads right into our carport and walkways and to the garbage. early on Monday morning a large flat bed truck came and dumped to very large industruial size bins, I guess to place trash in. no one from management told us this would be happening. we live in a very large complex ..garden style apartments with over 110 complexs it's an older complex with beautiful trees and walkways and garden areas. this construction is happening only to a few of us that live in this direct area. we have asked to be relocated to another unit since many of us have small children and feel this is going to be a hazard area. Management states that we can be moved but must pay the full rent for the new apartment 1560.00. we feel this is a slap in the face and should at least get some sort of discount or pay our normal rent canwetakeanyaction?

I doubt that you can do much about it...
It is a private complex and you are renters...

Sorry you are going through this. The better thing for them to have done was to announce to all tenants the wonderful new pool, gym facilities that are to be enjoyed by all at the completion of the project. Then at least you could have known it was coming.

Your rights are that the construction can only occur during the day time. Which in most areas means 7AM-7Pm. Most crews end earlier.
They must fence off the entire work area so that children cannot get into the construction zone and become injured. But they can leave the gate open all day for them to come and go. If there is no fence, call the city building department ASAP and tell them what's going on. They'll take care of it right away.

Call the manager, rather than lessers and tell them you want to stay in the building but that this is now very disturbing to you. Ask for a free months rent at the end of one year in the new apartment. Calculate what that savings would be to you monthly, if they will go for it. If so, and you can afford the higher rent. Go for it. Because even when they do finish the pool. The apts near the pool often suffer from noise related to the use of the pool.

I am sure your lease allows for the landlord to conduct/perform repairs and maintenance work on the property.....you can however, negotiate the construction time/days with the landlord so that you are least inconvienienced.

They don't ahve to relocate you at the same rent unless it would be impossible for you to continue living in your unit e.g. it burns down etc.....Therefore, if YOU choose to relocate they can charge you the higher rent....

They are supposed to report any major inconvenience to the respective tenants. You may try contacting the Management company and if necessary, your state Housing Department. If your apartment complex abides by fair housing guidelines, you may be able to contact the Housing department for your state and or county and they may be able to help. Best of Luck to all of you.

Read your lease agreement, but I suspect the answer is a resounding "No." Welcome to life as a renter.
