First of all, if he's staying out all night and not coming home, the first I would do is tell the landlord that you want to change the locks. Inform the landlord that you are changing the locks because you are divorcing your husband and he won't be living there anymore. Get a lawyer and serve divorce papers on him.
If he does come home in a drunken state and starts threatening you, call the police to haul him off. Make sure to file a police report.

Well...you can start to live your life for you and stop waiting on your husband to come home. Stop waiting on your husband. Regain your sense of identity and your sense of independence. Obviously, your husband has regained his and has made his decision about where to spend his time. Do you have any hobbies or activities that you would like to do? any thing that you may be interested in taking up...just for fun? Do you have any friends that you can hang out with on a regular basis? if not, then can you make some? Dont' just sit there and mope. Get up, get out, and live your life girl. While you did state that you did have a son, there are ways to handle having a life while making sure that your son is taken care of also. such as a babysitter. maybe if your husband starts to notice that you are no longer paying attention to him being out all night (meaning you are so engrossed in your own personal life) that may be a wake up call to him.

Get a lawyer to file an ex-parte petition and get custody of the child and petition to have him removed from the residence. Get a restraining order against him also.
Once you're done with all of that, you can see if he changes his tune. If he does, then get counseling and work this through slowly before you even consider letting him back in. If he does not change his tune then you move forward with the divorce and be done with this. Then you need to get counseling and figure out why you picked somebody like this to marry. You'll pick another dud if you don't look into it.
Do your best to be civil to him in front of the kid. Never say anything bad about him in front of the kid. You're doing this for the child's sake, not his. Talk him down to your friends all you want but never to your kid or in front of the kid.
Be good to yourself. Divorce really sucks but the situation you describe is worse than a divorce. You need to get out of this.

hey i understand what you are goin thru i am in florida also all my life floirda laws has been crazy after what happen with nicole and o.j simpson,i will say to you is the best thing to do since he staying out all night not coming home let him stay out and you go to the court house and file for a divorce i hate divorce and so do God.but this brotha is not a husband to you and he dont respect you at all if you like you can email me i am in the florida area also i may can help you more masheck4u@yahoo.com

U need to do everything u can to get him out. If he is staying out all night believe me he is cheating on u. If u have a vido cam or a camera follow him and get proof. Then it will be very easy to get him out of the house. Get a lawyer and ask him what to do. I say get out of this marriage while u still can before u end up with std or aids. Good luck.

change the locks. and if he doesn't come home, why can't you kick him out?
Change the locks, get a divorce, or get counseling. Whatever you do, don't put his belongings out in the street cause then you become responsible for them.
