The Creamy Layer by definition is the economically forwardcommunity, and the constitution forbids any reservation for them. Thus, creamy layer reservation is UNCONSTITUTIONAL Now, understand the the reservations are not there just like that, its a transitionary feature. Just cos there are reserved seats, it doesn't mean we HAVE to fill them by all means, if there are not enough SC/ST/OBC students, the seats should be given to well-deserving general-category students.. It all actually comes down to the govt giving enough support to Primary & Sec edu, so that these SC/ST/OBC students can be uplifted. But once uplifted, they enter the Creamy Layer, and their children will have to work hard, since they can afford it. If reservation is fair, excluding the creamy layer is equally fair

Yes. Creamy layer is to be excluded from reservation, because, even after 59 years of Independence, 20% of SC & ST vacancies are not filled and if we are including creamy layer in reservation, the SC & ST vacancies will not be filled at all. The same thing will be applicable BC also.
Let each one will be guaranteed for higher education and job then, there will not question of creamy layer and reservation.

I am olso from OBC but I think this cast based reservation is maintained only & only for political use.
And for this type of attitude only Muslims and dalitas have remained (?) (intentionaly kept) backward.
After 50 years of Independence also Why we need cast based reservation? And now this congress wants to give reservation to Muslims i.e they are trying to give now religion based quata.
And regarding creamy layer issue. why a well earning person should be given reservation?
Instead of this If reservation based on economical condition it will include OBC, SC, ST, Upper cast AND also Hindu, Muslim, Sikh, Krishtunes etc.
Cast and religion based reservation is only and only the votebank politics of congress. They want to keep them backward for their political purpose.
