My husband was ordered by the court in Italy (where his ex and kid live) to pay $400 monthly. Can they garnish his wages for that amount even though he only makes $1400 a month (the Italian part hired a lawyer here in Texas to get the money)? To us it's outrageously high, we simply can not afford it. It's almost 30%. He's the only one who brings an income and we're also on food stamps.

The courts only care about the woman getting paid. They don't care if the man starves. I am a man in the same financial situation as your husband except that I have not re-married. I lose 30% of my income, too (it is actually more, considering that it is taken out of my post-tax income). If I make my rent and car payments, I can't buy food. So, usually, the car payment or the rent payment is late. Sometimes, I use a credit card to buy food. And I am vegetarian, so the cost of food is low, but I still can't afford it. There is no point in my getting a second job. As soon as the court finds out, they will take away that income too. Besides, the judge can always say that you are making more than you really are. He doesn't need any proof. So, if you are really unlucky, you can have more than 100% of your income taken away for child support.

Here's a suggestion - umm get a job? get a second job? $400 a month? That doesn't even begin to house, clothe, and feed a child! That's nominal in my opinion.
