Apparently the guy is suing us because our insurance co won't pay out enough to him.
What happens now? Can he actually drag us to court and get money from us? I thought the insurance co was there to protect us from this situation?! What is going to happen?! Help!

DO NOT go to the prepaid legal site advertised above. Such sites are of questionable use here, and your insurance company is the one who will pay for your attorney.

Have you been served with a summons?
If so, then you need to contact your insurance company and inform them immediately. The insurance company has a duty to defend you, its part of your contract with them. That means they have a duty to hire an attorney for you, and pay the attorney. Any judgment they will also have to pay, up to the limits of the policy.

HOWEVER, you need to do this immediately. Most policies also require that you give the insurance company notice of the lawsuit within a certain time frame, or they may be able to wiggle out of coverage. Insurance companies are not out to protect your interests, they protect their financial interests, so if they can avoid payment, they will.

Contact your insurance agent IMMEDIATELY.

He can sue you.. but unless he has proof of acutual damages that exceed the insurance estimate he won't win (That pain and sufferng bull fewments stuff won't happen)

He really should have sued the insurance company first but....

Your Insurnace company must have told them they will not pay. Contact your agent. Some States have "no Fault" who was at fault?
Youe policy should have limits it will pay, read it.
