Well it depends on where you are and where he is. If he is in jail or prison, most facilities are tobacco free and it would be considered a contraband.
If you are sending it to another country, they may have other laws prohibiting certain items, such as tobacco, medications, alcohol, etc.

How much is a "small" amount? Are you shipping over state lines? It may have something to do with taxes placed on tobacco by individual states.

there is no law preventing you from doing so, tobacco companys send cigars, tobacco and etc via mail all the time. just make sure its 'legal' tobacco.
