In North Carolina if a person who is marred and never divorced remarries another person does that marriage become legal if the first spouse either dies or instigates a divorce? Or does a new marriage have to be preformed to satisfy the law? What statutes would apply?

No matter which state you are in the second marrige is not legal. the first one has to be taken care of then the second one needs to be done all over again.

no....the second marriage was never legal to begin with so some other event cannot suddenly make it legal....
