is in both names is it possible to have the land split?

the other party is refusing to have the land split. i have hired an attorney and this has been going on for over 1 year.

If your decision to separate the property is agreed upon by both parties involved, and an accurate legal description along with a recent survey has been acquired, then there is nothing that can be done by any outside interference because both parties already own the property, and no one other than yourselves can change that as long as the proper legal guidelines have been followed.

Yes it is possible. You will have to have the land surveyed and have new deeds drawn up. You will probably have to file this with some local office, like a County Recorder. Both people must agree to split the land. Contact your local government officials to see what steps are necessary in your locality.

that has to be left up to the zoning commission of wherever the land is, and if it can be broken to two properties. I would say for the most part, a 5 acre lot could be split to two, and a new deed for each property be created.
