I canceled my service over 8 months ago. They stopped billing me and wiped out my account. They out of the blue they started billing me again and billed me for 6 months before I realized that they were doing it. I called and they said that they only had to pay me 4 months because I signed a contract that any billing problems had to be reported within 120 days or it would be consided valid. I told them that they made a mistake and I should not be responsible for checking my bank statement every month to be sure that they are not billing me!! What can I do. This really pisses me off!!

I bet that they ARE doing this to a lot of people. How many people check their bank statements every month to be sure that something that they canceled months before is not still being billed to them!! I told the woman it sounds like a Class Action Law Suit to me and she just kept saying that I signed the contract. I said I don't remember that part and she said you would have had to sign it to get the service. Isn't that duress?

OK, so I don't read my bank statements. It is the principle of the thing! They ADMITTED it was their mistake. She found the notes and told me the exact date and time that I have canceled my service. Why is the victim to blame here!!!!

How do you get billed for something for six months and not realize it? You may have a case, but is it worth $45 to file the paperwork in court (you will have to pay a fee), possibly hire an attorney (this costs money), and waste your time and effort in a court. The main thing that is working against you is the fact that you did not contact them for six months about the mistake, showing your negligence here as well. I personally think it is a waste of time to pursue this further so chalk it up as a lesson learned the hard way and read your bank statements from now on.

This may not work- but it is worth a try- b/c legal help for this amount would not be cost effective to you.

Just call back- talk to a rep- when they tell you they cant help, speak to a supervisor- if they cant help- speak to their supervisor and so on.

Also if you found this out around 120 days- does that include working days or a 7 day cycle?
I had something similar happen- but I only had 30 days. I called to cancel on the 30th working day-they tried to pull that it was a calendar day - b/c I am anal- I pulled out the contract and stated that it did not specify that and b.s.ed that contracts that do not specify legally run on working days. Of course I had no idea if that was true...but b/c I sounded like I knew what I was talking about they refunded me the money.

you can hire a lawyer but that is going to cost you a lot more than 43.90. and they know this. they are probably doing the same to millions of people. they gotta make money for their stockholders somehow. be an informed american and find services outside of corporate america. find companies that are privately owned and don't let the bottom feeder fascists suck out your dollars or your soul.

i was screw by people pc then aol i never received money just credit i just canceled my account and now deal with verizon dsl i pay them monthly with a money order problem fix..my freind had same problem with net zero n out of them all earth link sux
