The problem isn't just with "liberal judges." Even conservative and moderate judges legislate rather than apply existing laws. And I am very pessimistic about this topic. I doubt that we ever can get rid of this problem.

Perhaps 'liberal' judges tend to work on the development of society, rather than expecting it to stay a fixed course.
