I have to compare the US constitution to Nebraska's constitution as a state. I was told that same sex marriages are allowed there, but then I read that it is-but it may be been banned again. If it is legal, what could I say in comparison to the US constitution?

The Defense of Marriage Act has been written into the state constitution. The ACLU filed a suit in 2004 in federal court in Nebraska challenging the state’s constitutional amendment banning same-sex marriage. On May 12, 2005, a federal judge struck down Nebraska's ban on gay marriage, saying the measure interferes not only with the rights of gay couples but also with those of foster parents, adopted children and people in a host of other living arrangements. The constitutional amendment, which defined marriage as a union between a man and a woman, was passed overwhelmingly by the voters in November 2000.
